A Frisco woman has filed a lawsuit against the operators of a Planet Fitness location, alleging she was secretly recorded while nude in a tanning room and that the gym failed to implement adequate safeguards to protect its members.
Filed Oct. 6, 2026, in Collin County, the lawsuit names Excel Fitness Holdings, LLC and Excel Fitness DFW 21, LLC, which own and operate the Planet Fitness at 6951 Preston Road in Frisco. The plaintiff, identified as Jane Doe, alleges a male gym member recorded her without her knowledge while she was undressing and using a tanning bed.
According to the lawsuit and media reports, Frisco police investigated the incident, arrested a suspect and discovered additional recordings and potential victims.
Lawsuit Alleges Pattern of Privacy Violations
The lawsuit alleges that more than 55 women were secretly recorded while nude at seven Planet Fitness facilities across the country over approximately 14 years. It further claims the gym operators failed to implement adequate security measures, procedures and staff training to prevent unauthorized recordings.
After researching similar incidents, Rogge Dunn, founder of the Rogge Dunn Group and attorney for the plaintiff, told CBS News Texas, “And then we did some research and found out this is not the first time this has happened. In fact, it’s happened at least seven other times that we know of all across the country.”
Dunn also raised concerns about the company’s alleged failure to notify members who may have been affected.
“Planet Fitness knew that this was happening, and they never sent a notice out to my client or any other woman in the club, saying you may have been videotaped,” Dunn told CBS News Texas. “They are putting profits over people’s privacy.”
Seeking Accountability and Stronger Security
Dunn emphasized that customers should be able to trust that designated private spaces are secure.
“When a gym claims to provide a private room, customers have every reason to believe they will actually be private,” Dunn said, according to WFAA. “Women should not have to worry about being secretly recorded in tanning and changing areas, and these owners should have taken reasonable steps to protect their customers, including our client.”
Dunn said the lawsuit is intended to push the gym operators to improve their security practices.
“We’re filing this lawsuit so Planet Fitness will take notice and increase their security,” he told WFAA.
He also called for inspections of private areas to help prevent future incidents.
“We want those tanning booths or dressing rooms to be inspected,” Dunn said.
The plaintiff has also described the emotional impact of the alleged recording and the difficulty of canceling her gym membership after learning what happened. According to WFAA, she said members must cancel in person at the facility, forcing her to return to a place associated with the incident.
Planet Fitness Responds
Planet Fitness issued a statement to CBS News Texas and WFAA emphasizing its commitment to member safety and privacy.
“At Planet Fitness, the safety and privacy of our members is our top priority, and we take these incidents extremely seriously. The franchise group is working closely with the local police in their investigation, and we direct you to the authorities for additional questions.”
The plaintiff is seeking more than $1 million in monetary relief, including compensatory and punitive damages, and has requested a jury trial. The lawsuit raises significant questions about facility security, customer privacy and the responsibility of businesses to take reasonable steps to protect their customers.
The allegations in the lawsuit have not been established as findings of liability.
